Official waiting list conditions
On this page · 9 sections
In the event of any discrepancy between versions, the Spanish version prevails.
What it is
These conditions are for race organisers that use Pasadorsal as their official waiting list. The organiser publishes in its dashboard the places that become available, each with a single-use registration code or link from its own platform, and Pasadorsal offers them in turns, in order of arrival, to the people on its list. Whoever accepts a place registers and pays on the organiser's platform. The list can be shown on the race website with the Pasadorsal widget or with a link.
Price and commitment
Each organiser has its own financial terms, which are set out in the agreement it signs: the starting offer is that the list is free for the organiser in the first edition of each race with Pasadorsal; with other organisers it may be the first race only, all races until a date, all races or none. If its terms ever change, the organiser will be notified 60 days in advance and they will never apply to a list that is already open: to open another, the organiser signs again under the new terms. There is no minimum commitment: the organiser can stop using it whenever it likes, by closing its list and writing to us. If the service has a price in the future, it will be agreed in writing with each organiser before it applies and it will never affect places already filled.
Before opening the list
To open the list, the data processing agreement signed with Pasadorsal (Article 28 GDPR; without it the list doesn't open) and acceptance of these conditions are needed, both in the current version and from the organiser's dashboard, together with the race's official registration link. If a new version is published, lists that are already open continue; to open another you must sign the new one. The organiser's staff sign in with their own Pasadorsal account. The organiser decides who is a member, keeps this up to date and is responsible for what its members do from the dashboard.
What the organiser does
The organiser is responsible for ensuring that each code or link it publishes is valid, single-use, from its own registration platform and for that race, and that it remains valid until the date it gives. It is also responsible for anything it publishes by mistake: the dashboard first shows a preview of what is about to be published, and the organiser can withdraw a place as long as nobody has accepted it. If it says that an accepted place was not used, it must provide a new code or first cancel the previous one on its platform, because the person who accepted it has already seen it.
The registration, its price and its payment, the refund to whoever releases the place, the change of bib and chip and the race conditions are matters for the organiser and its platform: Pasadorsal doesn't charge, receive or hold anyone's money. The organiser marks each accepted place as used or not used; if it doesn't do so within 30 days after the race, the place is closed unresolved.
The name and email of whoever accepts a place may only be used for their registration in that race. The organiser only places the widget on the websites it lists in its dashboard.
What Pasadorsal does
Pasadorsal offers each place in turns to the people on the list who have given their consent, with the duration set by the organiser (from 15 minutes to 72 hours; turns shorter than 8 hours don't start at night), never beyond the place's validity. If nobody on the list can receive it, the place is left unfilled and the organiser is notified. If someone who can receive it joins later and the code is still valid, it is offered automatically. It is never offered outside the list. It only gives the organiser the name and email of whoever accepts each place, and figures for the rest of the list. It does not guarantee that all places will be filled. On race day the list closes automatically.
Pasadorsal aims to keep the service running at all times, but there may be interruptions for maintenance or faults. If an outage of at least 5 minutes or a maintenance window takes time away from a turn, the turn is extended, never beyond the place's validity. Time that falls within a maintenance window is not added twice.
Personal data
To run a race's list, Pasadorsal processes the data of the people who join it on behalf of the organiser, under the data processing agreement (Article 28 GDPR), which states what is processed, with what measures and with which sub-processors (those in the privacy policy: UpCloud, Sweego and the backup provider). Pasadorsal is the controller for the accounts and the race's queue. The retention periods are those in the privacy policy: each place's code or link is deleted 30 days after it expires or is closed, and who accepted each place is kept for 5 years and then anonymised. Every time someone from the organiser checks who accepted a place, this is logged.
Deactivating the organiser
Pasadorsal may deactivate an organiser if it doesn't comply with these conditions or the data processing agreement, if it publishes places that aren't its own or aren't valid, if the organiser itself asks for it or if Pasadorsal stops providing the service. When it is deactivated, its lists close (no more sign-ups are accepted), its members can no longer access its dashboard and places already published continue to be offered until they expire or Pasadorsal withdraws them. Pasadorsal informs it by email, giving the reason.
Liability
Pasadorsal is liable for its own obligations: offering the places as explained here, storing the codes encrypted and not disclosing data it shouldn't. It is not liable for the registration or for what happens on the organiser's platform, or for a code or link that doesn't work or that was published by mistake. Nothing in these conditions limits liability that the law doesn't allow to be limited.
Changes and governing law
If these conditions change, each organiser will be notified by email at least 60 days in advance and the changes will never apply to a list that is already open; if it doesn't agree, it can leave the service at no cost. They are governed by Spanish law.
